The EEOC's, or the Equal Employment Opportunity Commission's, current rules allow employers to impose certain incentives or penalties on employees to encourage participation in wellness programs. A recent court ruling requires that the EEOC redrafts the rules as they are too arbitrary. Others say that these penalties often have the opposite effect than intended.
